CONTEST RULES AND REGULATIONS

 

 

 

Article I – Organization

 

Total S.A., a French société anonyme with a share capital of €6,315,850,770 headquartered at 2 place Jean Millier, 92400 Courbevoie, France, registered in the Nanterre Business Register under the number 542 051 180 (hereafter “the Organizer”), is holding a free contest with no purchase necessary entitled “Total Football League” (hereafter “the Contest”), from January 10, 2018 at 18:30 p.m. (noon) CET to February 4, 2018 at 10:00 p.m. CET, accessible at the website www.league.football-together.total.com (hereafter “the Website”) to coincide with the Total African Nations Championship 2018 (hereafter “Total ANC 2018”).

 

 

Article II – Contest Terms and Conditions of Entry

 

The Contest is open to anyone who has reached the age of majority (depending on their nationality) at the time of participation and having Internet access on that date, as well as a personal account at the Website and an email address at which the participant can be contacted for purposes of administering the Contest (hereafter “the Participant”).

 

Any person who does not have a personal account at the Website and wishes to participate in the Contest may create an account using Facebook Connect, Twitter Connect or Google+ Connect or by providing his or her full name, valid email address, password, country of residence and date of birth directly at the Website.

 

The following persons are barred from participating in the Contest: persons under the age of majority (depending on their nationality); employees of the Organizer; employees of SCP ABRAHMI BLANCHET JOUBERT, huissiers de justice, 56/58 avenue Jean Jaurès, BP56, 92210 CLAMART Cedex, France; and in general any person who directly or indirectly participated in developing the Contest as well as household members (i.e., persons having the same last name and postal address) of any person in the aforementioned categories.

 

In order to take part, each Participant must have a valid, permanent (not temporary) email address. In particular, temporary and/or anonymous email addresses (such as addresses ending in youumail.com, youpymail.com, yopmail.com, brefmail.com, mailcatch.com, yopmail.fr, yopmail.net, cool.fr.nf, jetable.fr.nf, nospam.ze.tc, nomail.xl.cx, mega.zik.dj, speed.1s.fr, courriel.fr.nf, moncourrier.fr.nf, monemail.fr.nf, monmail.fr.nf, etc.) and email addresses derived from domains created and/or registered in response to the Content shall be considered invalid.

 

Any participation via multiple email addresses linked to the same individual and/or via an email address opened on behalf of another individual is prohibited.

 

Your participation must comply with all of the foregoing provisions to be considered eligible. In that regard, the Organizer reserves the right to take all necessary steps to verify the identity, age and contact information of each Participant. Any incomplete, erroneous or falsified information, or information from which it is impossible to identify or locate the Participant, will render his or her participation null and void.

 

 

Article III – Terms and Conditions for Registering and Participating in the Contest

 

During the Contest period, predictions may be submitted for all matches. Random drawings will be conducted per phase of the Contest. The Contest is divided into the following phases (hereafter “the Phases”):

  • Phase 1: Group stage matches. A random drawing will be held at the end of each match day of the Championship, it being understood that such match day comprises eight matches that may be spread out over several calendar days, i.e. three (3) random drawings in all for this phase.
  • Phase 2: Quarter-final matches (one (1) random drawing).
  • Phase 3: Semi-final matches (one (1) random drawing).
  • Phase 4: Third-place match (one (1) random drawing).
  • Phase 5: Final match (one (1) random drawing).

 

To participate, Participants must proceed as follows between the Contest start and end dates (based on the login time and date in mainland France):

 

  • Visit the Website and sign in to their account.
  • Click on the “Play” button.
  • Check the box indicating acceptance of the rules and regulations.
  • Click on the “Confirm” button to access the Contest.
  • Make one or more predictions. Once confirmed, Participants are then taken to the “Predictions” page. They can then predict the outcome of one or more matches, based on their login date. They will indicate the winning team by selecting Team 1, Team 2 or a draw (by clicking on N).

For example, if the Participant logs in to the site on the first day of Phase 2 (quarter finals), he or she will be asked to predict the result of all four matches.However, if the Participant logs in to the site on the second day of Phase 2, he or she may only predict the result of two (2) matches.

  • Confirm their prediction(s) by clicking on the “Confirm” button at the bottom of the page. Participants may participate and change their prediction for a match up until 30 minutes before the match kick-off. Participants must confirm their predictions prior to the deadline for participation (date and time) to be considered.

 

 

The outcome of the match that determines the winning Participants is the score after regulation time, including stoppage time (two 45-minute halves and the additional minutes granted by the referee for stoppage time due to substitutions, injuries, etc.), and excluding extra time and penalty shootouts (hereafter the “Prediction period”). Thus, a Participant may have a correct prediction at the end of the match (i.e., at the end of regulation time including stoppage time, overtime and/or shootouts) but be eliminated from the random drawing because his or her prediction was not correct at the end of the Prediction period.

Example: Team 1 wins the final. A Participant predicted that Team 1 would win, but at the end of the Prediction period, the match is still a draw. The Participant is not eligible for the random drawing.

 

 

Article IV – Procedures for Determining and Notifying the Winners

 

Determination of the Winners and Grand Prize Winners

 

  • Random Drawing

 

During each Phase of the Contest, the Organizer will conduct one or more random drawings from among all of the Participants who correctly predicted the outcome of every match held during that Phase (hereafter the “Winner(s)”).

  • Phase 1: Nine (9) winners picked through three (3) random drawings:
    • The first random drawing will be held at the end of the first match day of the Championship and will pick three (3) winners.
    • The second random drawing will be held at the end of the second match day of the Championship and will pick three (3) winners.
    • The third random drawing will be held at the end of the third match day of the Championship and will pick three (3) winners.
  • Phase 2: The random drawing will be held after the quarter-final matches and will pick three (3) winners.
  • Phase 3: The random drawing will be held after the semi-final matches and will pick three (3) winners.
  • Phase 4: The random drawing will be held after the third-place match and will pick three (3) winners.
  • Phase 5: The random drawing will be held after the final match and will pick three (3) winners.

 

Each random drawing will be held within one week of the Championship match day or final phase concerned.

 

Each Winner will receive the prize indicated in Article V of these rules and regulations.

 

In the event that the number of Participants that have correctly predicted the outcome of the match(es) for the Championship match day in question or the final phase concerned is fewer than the number of possible winners, the Organizer will not conduct a random drawing and will automatically designate those Participants as Winners.

 

If no Participants correctly predicted the outcome of all of the Matches held on the Championship day in question or the corresponding final phase, the Organizer will not conduct a random drawing and will not award the specified prizes.

 

 

 

  • Ranking of the Top Players

 

In addition, for the duration of the Contest, the Participants will be ranked overall based on the number of points they obtain:

 

10 points for each Phase 1 match they correctly predict.

20 points for each Phase 2 match they correctly predict.

30 points for each Phase 3 match they correctly predict.

40 points for each Phase 4 match they correctly predict.

50 points for each Phase 5 match they correctly predict.

 

At the end of the Contest, the five (5) Participants obtaining the most points will win the prize that corresponds to their ranking, as defined in Article V below (hereafter “the Grand Prize Winners”).

 

If it is impossible to determine the five Grand Prize Winners automatically based on the winners list (notably if several Participants are tied), the Organizer will conduct a random drawing to determine the Grand Prize Winners and award the prizes in the order in which the names are drawn.

 

For example, at the end of the Total ANC 2018, four (4) Participants are tied in first place. The Organizer shall then randomly select a winner for each prize. The first name drawn shall win the VIP package, the second name drawn shall win the tablet, the third name drawn shall win the speaker and the fourth name drawn shall win the set of headphones. The fifth prize (official or replica Championship ball) will in this case be given to the Participant who finishes second in the rankings in terms of points.

 

Notification of the Winners and Grand Prize Winners

 

The Winners will be informed of their prize within approximately three (3) weeks of the random drawing via a confirmation email sent to the email address they indicated when creating their account at www.league.football-together.total.com. They will then have seven (7) days from the email date to confirm acceptance of their prize.

 

If the Winners fail to confirm their express acceptance within that time in accordance with the foregoing provisions, or if they expressly waive their prize during that time, they will lose all rights to the prize and may not claim it at a later date. In such a case, the Organizer will not conduct a new random drawing and will not award the specified prizes to another Participant.

 

The Grand Prize Winners will be informed of their prize within no more than fifteen (15) days of the Contest’s conclusion via a confirmation email sent to the email address they indicated when creating their account at www.league.football-together.total.com. They will then have two (2) days from the email date to confirm acceptance of their prize.

 

If the Grand Prize Winners fail to confirm their express acceptance within that time in accordance with the foregoing provisions, or if they expressly waive their prize during that time, they will lose all rights to the prize and may not claim it at a later date. In such a case, the Organizer will not conduct a new random drawing and will not award the specified prizes to another Participant.

 

Participants must confirm their predictions prior to the Contest deadline (date and time) to be considered.

 

Participants who are not selected in the random drawing and are not among the Grand Prize Winners will not be notified to that effect.

 

 

Article V – Prizes

 

Each randomly chosen Winner will receive the following prize:

 

1 official ball (or replica), valued at a maximum of €90 (ninety euros) excluding tax.

 

The Grand Prize Winners will receive the following prizes, depending on their positions in the ranking:

 

First-place winner (or the first winner selected at random in the event of a tie)

 

One VIP package for two (2) worth an estimated total amount of €5,000 (five thousand euros) excluding tax comprising:

  • Two (2) VIP tickets for the Total CAF Super Cup 2018 match (day and location to be specified later).
  • Round trip in economy class from the Grand Prize Winner’s city of residence to the city where the match is being held (the Organizer will determine the appropriate means of transportation depending on the distance to be traveled).
  • At least one night’s accommodation (depending on the Grand Prize Winner’s city of residence) to view the Total CAF Super Cup 2018 match (day and location to be specified later).
  • Transfers between the hotel and the stadium. The Organizer will determine the means of transportation.

This prize consists only of what is described above; nothing else is included.

 

To claim this prize, the Grand Prize Winner finishing in first place (by ranking or by random drawing in the event of a tie) and guest must:

 

  • Have a passport that is valid on the date of February 10, 2018 and for a period of six months thereafter.
  • Have obtained any required visa from the country hosting the Total CAF Super Cup 2018 match.
  • Be in good standing with the relevant governments and authorities, allowing them to travel to and in and stay in the country where the match is being held.
  • Have liability insurance.

 

The Grand Prize Winner who finishes in first place (by ranking or by random drawing in the event of a tie) acknowledges he or she is cognizant of the above and releases the Organizer from any liability in this regard.

 

Second-place winner: 1 electronic tablet, with a maximum value of €500 (five hundred euros) excluding tax.

 

Third-place winner: 1 audio speaker, with a maximum value of €200 (two hundred euros) excluding tax.

 

Fourth-place winner: 1 set of audio headphones, with a maximum value of €100 (one hundred euros) excluding tax.

 

Fifth-place winner: 1 official (or replica) Championship ball, with a maximum value of €90 (ninety euros) excluding tax.

 

The stated value of the aforementioned prizes corresponds to the usually charged or estimated public price, including tax, as of the date these rules and regulations were established. It is provided for reference purposes only and is subject to change.

 

None of the prizes awarded may be challenged in any way by the Winners or Grand Prize Winners. The prizes are non-transferable and will not be exchanged by the Organizer for their monetary value in cash or in kind, in whole or in part. However, in the event of force majeure as defined by statute or case law, the Organizer reserves the right to replace any prize it has awarded with one of an equivalent nature and value.

 

 

Article VI – Procedures for Presenting and Using Prizes

 

Winners and Grand Prize Winners will receive their prize in person at their local Total affiliate or in a Total network service station.

 

Any incomplete or inaccurate contact information will be considered invalid and will prevent the Winners and Grand Prize Winners from obtaining their prize.

 

The Organizer expressly provides no benefit or warranty regarding the use of the prizes.

 

The Organizer shall under no circumstances be held liable for any incident and/or accident that may occur during the use of a prize it has awarded and/or as a result of improper use of the prize by the Winners and Grand Prize Winners.

 

In the event that a Winner or Grand Prize Winner chooses not to assume possession or make use of the prize awarded in whole or in part, or is unable to do so, under the conditions described in these rules and regulations, said Winner or Grand Prize Winner shall be deemed to have waived in full his or her entitlement to the prize and may not claim any compensation or consideration from the Organizer in that regard.

 

 

 

Article VII – Statutory Filing and Requests for Rules and Regulations

 

These rules and regulations have been filed with the practice of SCP ABRAHMI BLANCHET JOUBERT, huissiers de justice, 56/58 avenue Jean Jaurès, BP56, 92210 CLAMART Cedex, France, (hereafter “the Practice”). The same will be true of any amendment to these rules and regulations.

 

They may be requested by mail in a letter postmarked before midnight on February 11, 2018, at the following address (hereafter “the Contest Address”):

The cost of postage for such a request will be reimbursed at the prevailing economy rate (20 grams) upon written request made to the aforementioned address. Only one reimbursement will be made per household (i.e., persons having the same last name and mailing address).

 

Reimbursement will be made in cash within roughly ninety (90) calendar days from receipt of the request.

 

Any such request that is illegible or incomplete, bears insufficient postage, is sent to an address other than the Contest Address or is sent after the specified deadline will not be considered.

 

In the event that the Contest is extended or postponed, the deadline for requests to obtain the rules and regulations and receive reimbursement for postage costs shall be extended accordingly.

 

 

Article VIII – Compliance with the Terms and Conditions for Participation

 

By entering the Contest, participants agree to be bound by these rules and regulations in their entirety.

 

The Organizer reserves the right to verify the accuracy of the data provided by the Participants. Any Participant who fails to comply with the terms and conditions for participation set forth herein or, in general, provides inaccurate, misleading or fraudulent information will be disqualified from the Contest. No consideration will be given to requests made by phone or in writing regarding the interpretation or application of these rules and regulations, the Contest procedures or the name of the Winners or Grand Prize Winners.

 

The Organizer reserves the right to shorten, extend, postpone or cancel the Contest for any reason or to modify the Contest’s terms and conditions for entry and/or operating procedures, on the condition that an amendment to that effect is filed with the Practice.

 

 

Article IX – Intellectual Property

 

Any names or trademarks cited in these rules and regulations or on any promotional media connected with the Contest shall remain the exclusive property of their owner or holder.

 

 

Article X – Reimbursement for Participation

 

Any Internet connection fees incurred to participate in the Contest will be reimbursed upon written request, at a flat amount equivalent to the cost, including tax, of a ten (10)-minute local telephone call from a land line charged at the applicable France Telecom peak-hour rates at the time these rules and regulations were established (i.e., a total flat rate of €0.28).

 

Only one (1) reimbursement may be requested per household (i.e., persons having the same last name and mailing address).

 

Participants must include the following information with their request:

  • Last name.
  • First name.
  • Mailing address.
  • Identification (email address and/or telephone number).
  • Bank account number (or postal account number).
  • A copy of the bill from the Internet service provider, with the login dates and times underlined.

 

Moreover, any request for reimbursement must be made in writing (with postage reimbursement requested at the same time) before February 11, 2018 or no later than ten (10) days after the date of the bill received from the Internet service provider, enclosed in a self addressed stamped envelope mailed at the current economy rate (20 grams) to the Contest Address.

 

Reimbursement will be made via bank transfer within an average of six (6) weeks from receipt of the written request.

 

Inasmuch as some Internet service providers offer their customers free or all-inclusive Internet access in light of the services and technology now available, it is expressly stipulated that free or flat-rate access to the Website (e.g., via a cable or DSL connection or a leased line) will not be reimbursed, since the customer has a subscription with the service provider for his or her use of the Internet in general. Therefore, connection to, and participation in, the Contest does not incur any additional costs or disbursements.

 

Any request that is illegible or incomplete or is sent after the specified deadline will be considered invalid. Requests for reimbursement may not be honored if the foregoing conditions are not met. Requests for reimbursement may not be made by telephone or via the Internet.

 

 

Article XI – Liability

 

The Organizer’s liability is strictly limited to the delivery of prizes that were actually and validly won, under the conditions set forth in Articles IV and VI of these rules and regulations.

 

It is expressly stipulated that the Internet is not a secure network. Accordingly, by entering the Contest, Participants acknowledge that they know and accept the properties and limitations of the Internet, particularly with regard to technical performance; the response times for consulting, querying or transferring information and data; the risk of disruption and more broadly the risks inherent in any Internet connection and transmission; the lack of protection for certain data against possible misuse; and the risks of being infected by viruses circulating on the Internet.

 

Therefore, the Organizer may not be held liable in particular for any virus infection or third-party intrusion in the terminal used by the Participants in the Contest, and disclaims any responsibility for the consequences incurred by the Participants while connected to the Internet via the Website.

 

Specifically, the Organizer may not be held liable for any injury caused to the Participants, their computer hardware and the data stored therein, or for any possible consequences with respect to their personal or professional activity. It is the responsibility of Participants to take all appropriate measures to protect their data and/or software stored or installed on their computer hardware against an attack of any kind. Users bear sole liability for their connection to the Website and participation in the Contest.

 

Moreover, the Organizer disclaims responsibility for any malfunction of the Internet, telephone lines or receiving equipment that disrupts the normal course of the Contest.

 

The Organizer may not be held liable if one or more Participants is unable to connect to the Website or compete in the Contest as a result of a technical problem or defect related to heavy network traffic.

 

Lastly, the Organizer may not be held liable for any injury caused to third parties or the rights of third parties by the Participants. Insofar as, by its nature, the Internet carries information that may be freely captured and used by third parties in ways that may be unbeknown to the Organizer and difficult or indeed impossible to monitor, the Organizer may not be held liable for any fraudulent use of the login rights or prize eligibility of a Winner or Grand Prize Winner unless it can be shown to be guilty of gross misconduct.

 

The Organizer will do its utmost to ensure access to the Contest via the Website at all times, but will be under no obligation to do so.

 

The Organizer may suspend access to the Website at any time, notably for technical reasons or to install updates or perform maintenance. The Organizer shall bear no responsibility of any kind for any such suspension of access or its consequences.

 

Moreover, the Organizer may not be held liable for any malfunction of the Internet, misdelivery or loss of regular or electronic mail or damage caused by the postal services.

 

In general, the Organizer may cancel all or part of the Contest if it deems that fraud of any kind has occurred, especially related to information technology, in connection with participation in the Contest or the determination of the Winners or Grand Prize Winners. In such a case, it reserves the right to refrain from awarding the prize to a person engaging in fraud and/or to pursue legal action against the perpetrators of fraud in the competent courts. It may not be held liable by Participants in any way for any fraud that may be committed.

 

 

Article XII – Force Majeure

 

In general, the Organizer may not be held liable in the event of force majeure or unforeseen circumstances beyond its control (such as technical problems) that disrupt the Contest’s organization and management in such a way that the Contest is shortened, extended, postponed, modified or canceled.

 

For the purposes of these rules and regulations, force majeure means any event that is unforeseen, insurmountable and beyond the Organizer’s control, so as to exempt it from its liability and release it from its obligations, in accordance with the case law of France’s Court of Cassation.

 

 

ARTICLE XIII – Attributes

 

By participating in the Contest, the Winners and Grand Prize Winners authorize the Organizer to use their full name, at no cost, for promotional purposes at the website www.football-together.total.com.

 

 

Article XIV – Data Protection

 

The personal data provided by the Participants will be processed electronically by the Organizer in accordance with the relevant legal provisions concerning personal data protection.

 

The Organizer will use the personal data it collects in connection with the Contest to manage participation in the Contest, contact the Winners and Grand Prize Winners and award their prize, and also to compile a database for purposes of commercial solicitation, subject to the prior approval of those involved. The data shall be retained for such time as is necessary for the aforementioned purposes.

 

The data will be forwarded to Total Marketing & Services and its affiliates, as appropriate, and to our partners: Havas Sports & Entertainment, Malherbe, Lagardère Sports & Entertainment and Capgemini.

 

In accordance with current laws and regulations governing the protection of personal data, Participants have the right to access, rectify and erase their personal data and to give instructions regarding that data after their death. Participants may also object, on legitimate grounds, to the processing of their personal data. Participants may exercise their rights by contacting the Organizer using the contact form available at the Website or at the following mailing address:

Article XV – Dispute Resolution, Governing Law and Assignment of Jurisdiction

 

If one or more provisions in these rules and regulations are declared null and void and/or inapplicable, the other provisions shall retain their full force and scope.

 

The Participants unconditionally acknowledge that by participating in the Contest they automatically become subject to French law, notably with regard to any dispute that may arise directly or indirectly from the Contest described herein, notwithstanding any conflict-of-law rules that may exist.

 

In the event of a dispute arising in connection with the Contest, the Organizer and the Participant shall attempt to reach an amicable solution. No challenge will be admissible more than two (2) months after the Organizer has concluded the Contest. If no agreement can be reached, the dispute shall be brought before the competent French courts, as provided for in the French Code of Civil Procedure.

1. Presentation of the Corporate Organiser

 

TOTAL, SA with capital of 6,321,148,030 euros, registered with the Nanterre Commercial Register of Companies under number 542 051 180, with its head offices located at 2 Place Jean Millier 92400 COURBEVOIE (hereafter referred to as the “Corporate Organiser”), from 19 December 2016 (starting at 6 p.m.) to 16 January 2017 (until 12 p.m.), a free game with no obligations called “Total Ball Kids” (hereafter referred to as the “Game”), accessible exclusively by Internet on the website football-together.total.com (hereafter referred to as the “Website”)

 

2. Game Duration

 

The game begins 19 December 2016 starting at 6 p.m. and ends 16 January 2017 at 12 p.m. (Metropolitan France connection date and hour apply).

 

3. Game Participation Conditions

 

3.1 Participation in the game is open to any individual aged 10 to 13 years when the Game begins, both members and non-members of a family with persons working for the Corporate Organiser, and having, on the day the Game begins, Internet access (fixed or mobile) as well as an account in the individual’s name on the Website and a personal email address where the individual can be contacted if necessary as part of conducting the Game (hereafter referred to as the “Participant” or “Participants”).

 

3.2 The Corporate Organiser calls attention to the fact that (i) as minors, each Participant cannot participate in the Game without having first obtained permission from his or her parents or any other legal guardian, and (ii) all the minor’s actions during his or her participation in the Game or relating to receiving and benefiting from the prize won must be carried out in the presence and under the supervision of the minor’s parents or any other legal guardian.

As minors, each Participant must receive written authorisation from his or her parents or legal guardians in order to participate in the Game.

The Corporate Organiser reserves the right to request, at any time, the following from each Participant’s parent(s) or legal guardian(s):

  •  proof of the parent or legal guardian’s consent allowing the Participant to participate in the Game;
  •  proof of the parent or legal guardian’s consent allowing the Participant to receive, should the case arise, one of the prizes offered as part of the Game;

 

 

This consent will be given in the format below:

  1. to participate in the “Total Ball Kids” game

This authorisation must be sent as either a scanned document or high-quality photo to the email address provided by the Corporate Organiser.

3.3 Only one Participant (same name, postal address and email address) per household (same name, postal address and IP address) is allowed to participate for the duration of the Game.

In the case of multiple entries, the participation of everyone in the household will be voided.

3.4 Anyone who does not fulfil the conditions set out in these rules will be excluded from participating in the Game.

 

3.5 Only those who fulfil all the provisions set out in these rules (hereafter referred to as the “Rules”) will be selected to participate. In this regard, the Corporate Organiser reserves the right to verify any information it judges useful in determining each Participant’s identity, age, contact information, physical fitness and knowledge of the rules of football. Any information provided by the Participant as part of the Game’s registration process, as described in Article 4 below, that is incomplete, untrue or fails to identify or provide an address for this Participant, will disqualify him or her from participating in the Game.

 

3.6 Game participation implies unconditional acceptance of the Rules and its principles. Any fraud or attempt to commit fraud in order to unfairly receive a prize, failure to observe the Game Rules or any malicious attempt to disrupt the Game will lead to the perpetrator’s disqualification, with the Corporate Organiser reserving the right to take legal action against said perpetrator. Similarly, if it is discovered that the Game is disrupted by a third party and a Participant acts as an accomplice in this disruption, his or her participation will also be considered void, and legal action may be taken against him or her by the Corporate Organiser.

 

 

 

 

4. Game Registration and Participation Procedures

 

Game participation is carried out exclusively over the Internet according to the procedures described below. Participation in any other way or by any other means, particularly by post, will not be considered.

 

To play, each Participant must, between 19 December 2016 starting at 6 p.m. and 16 January 2017 at 12 p.m. (Metropolitan France connection date and hour apply):

 

1.Go to the football-together.total.com website and click on the tab “At the heart of the Total Africa Cup of Nations 2017” to access Total's various computer games provided on-line as part of the Total Africa Cup of Nations – Gabon 2017;

 

2. Click on the “Total Ball Kids” section to go to the game;

 

3.Click on the button “Register” to access the Game participation page.

> Complete the following fields in the Game registration form:
 

  • Last name
  • First name
  • Date of birth
  • Country of residence
  • E-mail address
  • Phone number
  • Total Club card: yes or no
  • If yes, card number
  • Password
     

     > Users who are already registered on the Website will have to enter their e-mail address and password on the login page.

 

Tick the “I accept the Game rules” box at the bottom of the registration form, and then click on “Confirm

  • If the Participant has not filled out the registration form or login page correctly, one of the following messages will be displayed: “The XXXX field is mandatory” or “The XXXX field is invalid”

 

4. Allow the participating child to use the online tools available to Game players to create his or her own digital drawing based on the theme “What is a Total Ball Kid to you?” and click on the “Confirm” button to approve his or her participation. 

 

5. Fill in the following information for the participating child:

  • Child’s first name
  • Child’s last name
  • Child’s date of birth

 

6. Click on the “Confirm” button to finalise the participation process

 

The Participant’s drawing will be reviewed by a jury composed of members from the Corporate Organiser and the company Havas Sports & Entertainment at the end of the game.

 

5. Prize Awarding Procedures and Information

 

A jury composed of members from the Corporate Organiser and the company Havas Sports & Entertainment will meet within 72 hours of the Game’s end to deliberate and select the winning drawings.

The jury will select two winners from among those Participants having fulfilled the conditions set out in the Rules:
 

- a winner who is the child of an employee of the Corporate Organiser - a winner who is not the child of an employee of the Corporate Organiser

 

The Jury will make its decision based on the following:

  • Aesthetic appeal of the drawing
  • Relevance to the “Total Ball Kids” theme
  • Colours used

 

The Corporate Organiser will notify the Winners of their prize within a maximum of two (2) business days following the day of deliberation. Winners will be notified by the Corporate Organiser by e-mail using the contact information provided when registering to participate in the Game. The Winners will confirm at this time whether they accept the prize or not.

The prizes will be made available by the Corporate Organiser to the Winner’s parents or legal guardians only, based on the information provided and the declarations made in the Game participation form. In any event, prizes will only be awarded if the Winner’s parents or legal guardians have completely adhered to the conditions set out in Articles 3 and 6.2 of the Rules. Failing this, the corresponding prizes will be considered forfeit, and the Corporate Organiser will be free to select another winner.

 

For practical purposes, Participants who weren't selected will not be notified.

 

If the Corporate Organiser does not receive a response on behalf of the Winner according to the conditions and before the above mentioned deadline, or if the Winner expressly renounces his or her prize within forty-eight (48) hours of being contacted by the Corporate Organiser, the prize will be considered forfeit and re-awarded to another participant.

 

 

6. Game Prizes

 

6.1. Prize Descriptions

 

Both winners will receive:

  • A return ticket for two persons (the Winner and an accompanying adult) from the Winner’s place of residence to Libreville (Gabon) in economy class, the value of which will depend on the departure city;
  • Accreditation to participate as a ball kid during the Total Africa Cup of Nations final on 5 February 2017;
  • A seat in the stands for an accompanying adult during the Total Africa Cup of Nations final 5 February 2017, with a value of approximately 40,000 CFA;
  • A 3-night stay for two persons in an economy-class hotel, with a value of approximately 126,000 CFA per night, including transfers and meals, from 3 to 6 February 2017 (these dates may be changed at the Corporate Organiser’s discretion);
  • A “Total Ball Kids” uniform, with a value of approximately 50 euros.

 

In this regard, it is expressly agreed that, in order to benefit from this prize, the Winner must be accompanied by one of his or her parents or a legal guardian (hereafter referred to as the “Accompanying Adult”); one of the return tickets as well as a seat to watch the Total Africa Cup of Nations final, as mentioned above, are reserved exclusively for the Accompanying Adult.

 

The values indicated for the prizes described above correspond to current or estimated retail prices including tax on the date the Rules were written. They are given for illustrative purposes only and are subject to change.

 

The prizes to be awarded only include that which is indicated above and exclude all other items, such as telephone calls, faxes or Internet access, upgrades, purchases and any other personal expenses, which are to be paid entirely and exclusively by the Winners.

None of the prizes awarded can be disputed in any way on the part of the Winners. Each prize awarded is strictly personal, signifying it cannot be transferred or sold to a third party in any circumstance; it is not subject, on the part of the Corporate Organiser, to any cash reimbursement, exchange or any total or partial remittance against its exchange value, in cash or in kind. Nevertheless, in cases of force majeure as defined by statute law and case law, the Corporate Organiser reserves the right to replace any one of the announced prizes with a prize of equivalent value and/or similar characteristics.

 

A single prize will be awarded per person during the entire Game.

 

Finally, it is expressly agreed that no remuneration can be demanded by the Winner as part of participating in the capacity of a ball kid during the Total Africa Cup of Nations final. In fact, those individuals with parental authority acknowledge having expressly understood that their child’s participation corresponds to a prize obtained by the Winner as part of a contest. As a result, those individuals with parental authority acknowledge having received all compensation to which they are entitled by this sole awarded prize and will not be able to claim any remuneration in return.

6.2 Essential and decisive conditions for receiving prizes

 

To be able to obtain their prizes, the Winner and Accompanying Adult must comply with all the conditions listed below:

 

  • Send the Corporate Organiser or any company acting as a substitute, within 5 calendar days from the day of the decision:
    1.  For the Winner only: a medical certificate dating from less than 1 (one) year declaring the Winner able to play football;
    2. For the Winner and Accompanying Adult:
      1. vaccination record certifying that both are up to date with their diphtheria-tetanus-polio, yellow fever and hepatitis A vaccinations
      2. a public liability insurance certificate covering the Winner and the Accompanying Adult
    3. Certificate mentioned in article 3.2 above duly signed by the Winner's parents or legal guardians
  • Be well-informed by a doctor about how to prevent malaria
  • Answer satisfactorily at the interview that the Corporate Organiser, or any company acting as a substitute, will organise in order to ensure the Winner's physical aptitude (run fast, catch and throw balls) and football knowledge. This is an essential and decisive condition for the Winner receiving the prize. In the event that the interview proves not to be conclusive, the prize will be considered lost, and the Corporate Organiser will be free to choose another Winner.

 

In the event that the Winner and/or the Accompanying Adult do not meet the conditions listed above, the prize will be considered lost and the Corporate Organiser will be free to choose another Winner.

 

6.3. Presentation terms and conditions

 

Terms and conditions for travelling will be sent by email to the Winners and their Accompanying Adults at the email address that will have been given to the Corporate Organiser at registration within ten (10) calendar days from the reception of all the documents mentioned in article 6.2 above.

 

Any prize that is not delivered and is returned to the Corporate Organiser in the event of the Winner providing an incomplete or inexact email address will be lost by the Winner and will remain the property of the Corporate Organiser, without the latter incurring any liability as a result. Moreover, the Corporate Organiser declines all liability in the event of an incident or accident that might occur when using or benefiting from the prize.

 

As the prize is match tickets, the Winner undertakes to comply with and ensure that any person accompanying him or her complies with, on the one hand, the general conditions of sale applicable to the winning tickets made available to the general public by the match organiser, and on the other hand, the terms of the rules and regulations of the stadium, the procedures for accessing the stadium, seats and pitch, as well as the legal and regulatory provisions applicable in the stadium during matches held there, particularly concerning security, which are made available to the public by the organisation in charge of stadium security.

 

In this regard, the Winner is informed that they will be held directly and personally responsible for not respecting the aforementioned rules without the Corporate Organiser incurring any liability in any way as a result. In particular, the Winner is informed that any match tickets that find their way onto the unofficial market or any resale website are liable to be immediately cancelled by the match organiser, without the Winner in the same scenario being able to obtain from the Corporate Organiser any reimbursement and without prejudice to any proceedings undertaken by the match organiser against the reseller.

 

Under no circumstances will the Corporate Organiser be held liable for any incident and/or accident that may occur during enjoyment of the allotted prize and/or as a result of its improper use by the Winner and/or the Accompanying Adult.

 

In the event that the Winner does not want to or cannot, for any reason, take possession of or benefit from all or part of the prize won under the conditions described in these regulations, the Winner will be considered as having waived the aforementioned prize in its entirety and will as such not be able to claim any damages or compensation from the Corporate Organiser.

 

For all purposes, it is hereby stated that the Corporate Organiser will not provide any service or guarantee relating to the use of the prize on offer.

 

7. Legal submission and consultation of Rules

The Competition regulations are sent, free of charge, to anyone who requests them via the website contact form.

The Rules can also be consulted in their entirely on the website football-together.total.com.

 

Only the French version of these Rules are admissible.

All versions other than the French version are only for convenience.

 

8. Changes to the Rules

 

The Corporate Organiser reserves the right to make any changes to the Rules and/or Website at any time, without prior warning or an obligation to justify its decision and without it incurring any liability as a result.

Any changes to the Rules will lead to a new submission to: SCP Alain SARAGOUSSI – Rémi CHAVAUDRET, associated bailiffs, 33 galerie Véro-Dodat 75001 PARIS and will come into effect as soon as it is published online. Every participant will be considered to have accepted it simply be participating in the game, from the date the change comes into effect. Any participant refusing the change or changes made must stop participating in the game.

 

The Corporate Organiser reserves the right to, at any time and without prior warning or obligation to justify its decision, shorten, prolong, postpone or cancel the Game as well as modify all or part of the entry conditions and/or terms and conditions for implementing the Game, in case of force majeure or events beyond its control, without incurring any liability or any claim for damages as a result.

 

9. Reimbursement of cost of entering (cost of accessing the internet)

 

9.1. Conditions pertaining to request for reimbursement

 

Any Participant in the Game having adhered to the entry and participation conditions as mentioned in these regulations can obtain a reimbursement for costs incurred to connect to the website football-together.total.com via an internet connection (computer or mobile) and to participate in the Game, upon written request addressed to the Game Address within ten (10) days from the date of the end of the Game (as attested to by the postmark) or at the latest within ten (10) calendar days after the date on the invoice concerned from the Internet access provider if the Participant received it after the end of the aforementioned period, by indicating legibly on a separate sheet of paper the full name, full postal address, date(s) and times spent connected to the site football-together.total.com to participate in the Game, and by enclosing a copy of the itemised invoice from the service provider to which the Participant is subscribed, with the connections date(s) and times clearly highlighted.

 

The name of the Participant asking for the reimbursement must be the same as the name mentioned on the telephone network's invoice.

 

Any requests which are incomplete, illegible, and/or sent to an address other than the Game Address or after the aforementioned period has passed (as attested to by the postmark) will be considered null and void.

 

Only one request per person will be accepted.

 

9.2. Terms and conditions for reimbursement of cost of accessing the internet

 

Internet connection costs for participating in the Game will be reimbursed to any Participant who makes a written request according to the terms and conditions defined in article 9.1 above.

 

It is understood as such that the Corporate Organiser only undertakes to reimburse Participants having accessed the website football-together.total.com via a computer internet connection and adhered to the Game entry and participation conditions in these Rules.

 

If the Participant accesses the Game via a modem and through a telephone line invoiced pro rata for the communication or call time, and only in that case, the Participant can obtain a reimbursement for these communications under the conditions mentioned in article 9.1, namely by making a written request to the Game Address and based on the documents attesting to the connection time for accessing the Game and the tariff imposed by the internet access provider. Costs for photocopying the supporting documents that must be enclosed with the reimbursement request will be reimbursed on the basis of ten centimes (€0.10) per sheet. Postage costs for the reimbursement request will also be reimbursed, following a written request to that effect accompanying the internet connection costs reimbursement request, at the current second class mail rate (basis: 20 g). The reimbursement will be made in postage stamp(s) for a value equivalent or immediately superior to the sum to be reimbursed within an approximate period of ninety (90) calendar days from reception of the reimbursement request, after its validity has been verified. In this respect, the Corporate Organiser will not be bound to reimburse if the participation at the origin of the reimbursement request does not comply with these Rules or if the reimbursement request has not been made in the format and within the periods indicated in article 9.1 above.

 

To the extent that for certain service offers, certain internet access suppliers offer Participants a free or fixed-rate internet connection, it is expressly agreed that any access to the website football-together.total.com made on a free or fixed-rate basis (such as, for example, connection by cable, ADSL or dedicated line) cannot give rise to any reimbursement. In this case, the subscription to the access provider's service is contracted by the Participant for their use of the internet in general and the Participant connecting to the website football-together.total.com and participating in the Game does not result in them incurring any extra cost. Similarly, the IT or electronic equipment used to participate in the Game is not reimbursed, and as such the Participants acknowledge and declare that they have access to it for their personal use.

 

10. Liability

 

10.1. The Corporate Organiser's liability is strictly limited to delivering prizes effectively and legitimately won.

 

10.2. It is expressly stated that the Internet is not a secure network. As such, participating in the Game involves all Participants knowing and accepting the features and limits of the Internet, particularly regarding technical performance, response times for consulting, examining or forwarding information, risks of interruption, and more generally, the risks inherent to any connection or transmission via the internet in general, the absence of protection of certain data against possible wrongdoing and the risks of contamination from potential viruses on the Internet.

 

As a consequence, the Corporate Organiser cannot be held liable for the contamination by any viruses or the intrusion by a third party in the Game Participant's system terminal and declines all responsibility for consequences of the Participant's connection to a network.

 

In particular, the Corporate Organiser cannot be held liable for any damage done to Participants, their computer equipment and to data stored on it, as well as consequences that could ensue for their personal and professional activity. All Participants must take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack. Any person connecting to the website football-together.total.com and participating in the Game does so at their own liability.

 

10.3. The Corporate Organiser also declines all liability in the event of the malfunctioning of the internet network, the website football-together.total.com, telephone lines, or receiver equipment preventing the Game from being properly conducted.

 

The Corporate Organiser will not be held liable in the event that one or more Participants are unable to connect to the website football-together.total.com or play because of a technical fault relating to the network being overloaded.

 

The Corporate Organiser can cancel all or part of the Game if it appears that fraud in any form has been committed, particularly via a computer, while participating in the Game or deciding on the Winners. If this happens, it reserves the right to not allocate prizes to those committing the fraud and/or seek prosecution of the perpetrator of these frauds. It will nevertheless incur no liability of any sort vis-à-vis Participants as a result of any fraud committed.

 

10.4. The Corporate Organiser will do its best to allow access at all times to the Game on the website football-together.total.com, without any obligation to do so. The Corporate Organiser can, at any time, for example for technical reasons or due to updates or maintenance, interrupt access to the website and/or the Game that it contains. The Corporate Organiser will not accept any liability for these interruptions or their consequences.

 

10.5. Additionally, the Corporate Organiser's liability cannot under any circumstances be incurred in the event of the internet network not working properly, delivery problems or loss of post or email, as well as any damage resulting from the postal services.

 

11. Agreement on evidence

 

The Corporate Organiser has put in place the technical means necessary to demonstrate the participation or non-participation in the Game by an internet user. It is therefore agreed that, excluding patent error, the data contained in the Corporate Organiser's information systems are conclusive regarding connection elements and information resulting from an IT process relating to the Game.

 

It is agreed that, except in the event of a patent error, the Corporate Organiser can invoke, particularly as a means to prove any act, fact or omission, programmes, data, files, recordings, operations and other elements (such as progress reports and other reports) of an electronic or IT nature, in electronic or IT format or on electronic or IT media drawn up, received or kept directly or indirectly by the Corporate Organiser, including in its information systems.

 

Participants undertake to not contest the admissibility, validity or conclusive nature of the aforementioned elements of an electronic or IT nature, in electronic or IT format or on electronic or IT media, on the basis of any legal provision whatsoever and which would specify that certain documents must be written or signed by the parties to constitute proof. Thus the elements considered constitute proof and, if they are produced as proof by the Corporate Organiser in any contentious or otherwise procedure, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same conclusive nature as any document drawn up, received or kept in writing.

 

12. Intellectual property

 

All designs, names or brands cited in the Rules as well as on all communication documents relating to the Game remain the exclusive property of the Corporate Organiser.

 

The reproduction, representation or use without prior written permission from the Corporate Organiser of any or all of the elements making up the Game (photos, videos, names, logos, brands, etc.) are strictly forbidden.

Participating in the Games implies the Participant's waiving of the copyright on original work he or she has created. This waiving of rights will be confirmed according to the following terms:

  • The Participant cedes to the Corporate Organiser, or any company acting as its substitute, the right to reproduce, represent, have represented and adapt the creations/productions addressed to the Corporate Organiser as part of the Game, via the media listed below.

 

  • The Participant expressly accepts that his or her creations/productions be reproduced and/or represented on the following media:

 

  • The Corporate Organiser's Facebook page
  • The Corporate Organiser's Twitter page 
  • The website football-together.total.com.

 

  • This permission is given freely, for the whole world, for a three (3) year period from the date when the Participant was designated the winner by the Corporate Organiser

 

  • The Participant certifies that they have full power to consent to this ceding and guarantees to the Corporate Organiser the quiet use of his or her creations/productions, particularly against any third party breach of quiet use of any sort, for use of his or her creations/productions and persons or property featured in them.

13. Data Protection - personal information

 

13.1. The personal information gathered as part of this Game is obligatory. It is for the Corporate Organiser, as well as TOTAL MARKETING SERVICES and its subsidiaries if necessary. They will be transferred to their partners Lagardère, Havas & Entertainment and the CAF as well as to Malherbe only as a means of considering participation in the Game, managing the Winner, allocating prizes and to satisfy legal and regulatory obligations.

 

In accordance with French law n° 78-17 modified on 6 January 1978 relating to IT, files and data protection (known as the "Data Protection Law"), each Participant has the right to access, rectify, delete or oppose personal information concerning them. All Participants can exercise this right through a written request sent either via the contact form, or sent to the Game Address, stating his or her full name and postal address and enclosing a photocopy of his or her ID:

To the extent that the data collected on each Participant as part of the Game is essential for considering his or her participation and awarding the prize that he or she may have won, the exercising by a Participant of his or her right of withdrawal before the end of the Game will result in the automatic cancellation of his or her participation in the Game.

 

13.2. Each Game Participant acknowledges awareness of all the stipulations of the Rules and consequently acceptance in full knowledge of the facts. By simply participating in the Game, the Winner authorises, free of charge, the Corporate Organiser to use his or her full name(s) and indicate his or her town and drawing on the website. In the event where the Winner doesn't want this, he or she must tell the Corporate Organiser in writing at the Game Address.

 

14. Applicable law and competent court

 

If one or more stipulations of these regulations were declared null and void and/or non applicable, the other clauses would retain all their force and significance.

 

The Participants admit without reserve that the simple fact of participating in the Game necessarily subjects them to French laws, particularly any dispute that may arise from the Game or be directly or indirectly related to it, without prejudice of any conflict rules of laws that may exist. Any disagreement arising from the Game will be the subject of a attempted amicable settlement between the Corporate Organiser and the Participant. In the absence of an agreement, the dispute will be submitted to the competent French courts in accordance with the French Civil Code.

 

No telephone or written requests concerning the interpretation or application of these Rules, the mechanisms or terms of the Game or the designation of the Winners will be responded to.

RULES FOR THE CONTEST EXTRACT

“SELFIE SUPPORTER AFCON TOTAL 2017”

 

Article 2. Description of the Contest

The contest consists in the taking of a photograph by each contestant in a Total service-station participating in the operation and its publication on a dedicated website www.football-together.total.com/selfie (hereinafter referred to as the “Website”) in order to collect the highest number of “votes” (hereinafter referred to as the “Contest”).

The registration to the Contest starts from January 6, 2017 at 9 am and finishes on February 5, 2017 at 12 pm (Paris time).

The rules defined herein are the rule applicable to the Contest (hereinafter referred to as the “Rules”).

Article 3. Conditions for participation

Participation in this Contest implies the Contestants’ acceptance of all the conditions set out in these Rules.

The Contest is open to any natural person who is an adult at the time of its participation (hereinafter referred to as the “Contestant”).

The following persons are not eligible to enter the Contest: the Organizer, the managers and members of staff of the Organizer, any persons having contributed directly or indirectly to the organization of the Contest, as well as members of their families: spouses or partners, descendants and relatives in the ascending line who live under the same roof and use the same address.

Participation in this Contest may require the acceptance of “cookies” by the Contestant’s internet browser.

Article 4. Participation process- Stages in the Contest

This Contest requires no purchase and includes two successive stages:

  • the registration of the Contestant on the Website; and
  • the publication of the Contestant’s photograph on the Website and the sharing of the photograph via social networks.

4.1 First stage: Registration on the Website

Each Contestant shall connect onto the website www.football-together.total.com/selfie between January 6, 2017 at 9am (Paris time) and February 5, 2017 at 12 pm (Paris time) to register and fill the online form by indicating:

  • their country,
  • their title surname and forename,
  • their valid email address (optional),
  • their phone number,
  • their acceptance of the Rules.

4.2 Second stage: Publication of the Contestant’s photograph on the Website and sharing of the photograph on social networks

Each Contestant shall go to a Total service station participating in the Contest between January 6, 2017 at 9am (Paris time) and February 5, 2017 at 12 pm (Paris time) and take a photograph of himself/herself in front of Selfie Supporter visual via his/her smart phone or a dedicated terminal. Each Contestant shall then publish the photograph on the Website and share it on a social network (Facebook, Instagram, Whatsapp...) in order to obtain the maximum number of votes on Website.

The sharing of the photograph on a social network must include a hashtag (#) followed by “[…]” without any space between the # and this mention.

The Organizer reserves the right to withdraw, without prior notice, any content posted on the Website which would violate the applicable law. The Organizer reserves the right to involve the civil and/or criminal liability of the Contestant, in particular in case of contents with racist, offensive, defamatory or pornographic character. 

The publication of the photograph on the dedicated Website must occur between January 6, 2017 at 9am (Paris time) and February 5, 2017 at 12 pm (Paris time).  

4.3 Participation terms

Participation in the Contest cannot take place through any other means than the one described above. Any participation by other means shall be disqualified.

If the Contestant is not the owner of the computer and the Internet connection used to participate in the Contest, it shall be assumed that he/she has obtained the owner’s permission to use them.

The Organizer reserves the right to carry out all verifications necessary in terms of Contestants’ identity, age and e-mail address. Any inaccurate or fraudulent information communicated during the registration on the Website shall be disregarded and disqualified from the Contest.

The counting of the votes per photograph published by the Contestants registered on the Website will take place at the latest on February 14, 2017. Only the votes registered before February 5, 5017 at 12pm will be taken into account.

It is stated that the Contestants who would not fill properly the boxes on the form relating to their country, name, surname, and phone number, during their registration on the Website, will not be able to participate to the Contest.

The same applies to Contestants who will have refused that their full name be mentioned by the Organizer upon the Contest’s results announcement, in case they would win. 

4.4 Prizes

The prizes to be won are left to the Organizer's free choice.

In case of an equality of votes, the Contestants shall be distinguished by the date and time of their registration on the Website. 

It is stated that the prizes cannot be exchanged in any case against their cash equivalent, or against any other prize of whatever nature, even in case of equal value.

However, in case of force majeure or events out of the Organizer’s control and if the circumstances require it, the Organizer will have the right to grant winners a prize of close characteristics and equal value.

4.5 Results Announcement

The Contest’s results will be announced at the latest on February, 14 2017.

The full names of the winners will be indicated upon the results’ announcement, excluding other data.

The Contest’s winners shall be informed by phone call or SMS and contacted by the Organizer through the phone number indicated on the application form, in order to agree on the modalities of the prize’s delivery. This delivery should take place within a period of forty eight hours (48h) after the results announcement, in one of the Total service stations involved in the Contest. This phone conversation could be registered by the Organizer. It is agreed that the Organizer could then use this registration, in particular to obtain evidence in compliance with the article 18 of the present Rules.

The Organizer shall in no way be responsible if the contact details do not correspond to the ones indicated on the Contestant registration form and/or if the winner cannot be reached within a forty eight hours (48h) delay, starting from the announcement of the result.

Article 6. Personal data

 

6.1: Purpose of processing

Contestants are required to provide personal data. The personal data gathered during Contestants’ registration for the Contest are recorded by the Organiser for the purposes of conducting the Contest and are, subject to the Contestant’s acceptance, processed electronically to create a file that the Organiser and its partners can use for promotional and commercial purposes.

The Organizer is responsible for the processing of personal data.

The collection and processing of personal data shall be carried out in accordance with the law.

6.2 Recipients

Besides the Organizer, the Contestants’ personal data that is collected may be communicated to TOTAL S.A. and to any entity in which Total S.A. directly or indirectly owns more than fifty percent (50%) of the share capital or voting rights (“Affiliates”) in the frame of this Contest.

The personal data may also be communicated to jury members, partners, service providers and subcontractors on behalf of the Organizer and only for the performance of their tasks in the frame of and during this Contest.

The personal data will not be disclosed unless requested to do so by a judicial authority or any administrative authority empowered by law, in accordance with applicable laws in the country where the application has been submitted.

6.3 Data security and privacy

The Organizer will take appropriate steps to protect the security and privacy of personal data and, in particular, to prevent it from being distorted or damaged, or accessed by unauthorized third parties.

6.4 Duration of data retention

Data will be retained by the Organizer for the length of time required for data processing.  

6.5 Contestants' rights

Contestants have the right to access, to correct, to delete and to inquire about their data. Contestants may also object, for legitimate reasons, to the processing of their personal data. Contestants may request to have their personal data sent to them in an accessible format. The Organizer reserves the right to refuse any requests considered improper or abusive. Contestants may define guidelines related to the detention, the deletion and the communication of their data after their death.

6.6 Recording and use of the “cookies”

Contestants are informed that the Organizer is likely to use temporary "cookies" valid for the duration of the Contest.

These "cookies" are data stored in the Participants’ computer RAM. They do not permit to identify the Contestants; however they record information relating to the navigation of their computer on the website (pages viewed, the date and hour of the consultation, etc.) which will be visible during their subsequent visits.

Contestants are free to refuse the recording of the "cookies" by configuring their browser. Opposition to the registration of "cookies" may impair their browsing at www.football-together.total.com, as well as their participation in the Contest.

Article 7.Image rights

Contestants authorize TOTAL S.A. and/or any Affiliates to use, to represent, to reproduce and to publish any information and image concerning them in connection with communication and publicity relating to the Contest, on any media, in every country without being able to claim any right or any compensation whatsoever for three (3) years from the time of their registration on the Website.

The reproduction, public display, and exploitation of any or all elements (photos, videos, names, logos, brands, etc.) relating to the Contest and Total Group by the Contestant and without the Organizer's prior consent are strictly prohibited.

Article 8.Confidentiality

"Confidential Information", within the meaning of this clause, includes all tangible and intangible information of any kind, including in particular administrative, commercial, scientific, technical, financial, tax, legal, and economic information that has been, is being, or will be transmitted directly or indirectly by the Organizer to the Contestant, or to which the Contestant has had, has or will have access in the frame of the Contest, including but not limited to by verbal means, in writing on any media, and on paper or electronic documents. The following does not constitute Confidential Information: (i) Information that is currently or becomes accessible to the public without any breach of the terms of these Rules on the part of the Contestant, (ii) information that is lawfully held by the Contestant before it is disclosed by the Organizer, and (iii) information that is duly obtained from a third party who is authorized to transfer or disclose said information.

Contestants agree, for the duration of the Contest and for a period of two (2) years thereafter, not to use or disclose the Confidential Information other than in relation to their participation in the Contest.

Article 9.Filing of the Rules

These Rules are freely accessible on the Website.

Only one reimbursement request will be accepted per Contestant.

Article 10.Ethics

The Organizer affirms its commitment to respect the most stringent rules against corruption, fraud and anti-competitive practices and expects from each Contestant to respect such commitment.

Each Contestant also commits to disclose any potential conflict of interest that may arise during its participation in the Contest i.e. the existence of any family, professional or other relationship, which could cause its application to be questionable.

Article 11.Modification, suspension or cancellation

The Organizer shall not be liable if, in the event of force majeure or events out of its control, the Contest is cancelled, postponed, suspended, modified or shortened.

It reserves in all cases the possibility of extending the participation period and to postpone any date or time announced. Additions and modifications to these Rules may be published during the Contest. They will be considered additional clauses to these Rules. Any changes will be announced ahead of time by any appropriate means.

The player is considered to have accepted these modifications by virtue of his/her participation in the Contest counting from the date of the modification’s entry into force.

The Organizer may cancel the entire Contest or a part of it if fraud appears to have occurred in any form whatsoever, in particular electronically, in the framework of participation in this Contest.

In this event, it reserves the right not to award a prize to those responsible for the fraud, to reclaim the prize in the event that fraud is discovered after it is awarded, and/or to take legal action against those responsible for or involved in the fraud.

Article 12.Liability

12.1 The Organizer shall not under any circumstances face any claims of liability or be held liable if it does not receive entries for reasons beyond its control, including in particular in the event of Internet connection problems or if entries are received in a format that is unreadable or impossible to process.

The Organizer also cannot be held liable for any direct or indirect damage or loss relating to the prizes or the Contest process. The results of the Contest, for both the pre-selection phase and the final phase, are not subject to appeal.

It is stated that the Organizer organizes in its name and on its behalf the Contest. Neither TOTAL S.A. or any Affiliates shall be liable in that regard.

The Organizer reserves the right to interrupt, extend, shorten, modify, or cancel the Contest at any time, without having to give reason, and without incurring any liability in this regard. The Organizer thus cannot be held liable in the event of schedule changes.

Contestants are invited to consult these Rules and the Website regularly. Contestants expressly waive all claims and disputes relating to any changes made to the Rules by the Organizer.

No claim shall be accepted.

Article 15.Invalidity

The invalidity of one or several articles of the present Rules shall not affect the validity of the other articles.

Article 16.Independence

Registration and participation in the Contest does not create any relationship of subordination between the Organizer and Contestants.

Accordingly, such information constitutes evidence and, if it is produced as evidence in any litigation or other proceedings, it will be admissible, valid, and enforceable against the parties in the same way, in the same conditions, and with the same probative value as any document established, received, or stored in writing.

Article 19.Disputes – Applicable law

In the event of a dispute regarding the conditions of these Rules or their interpretation, the Contestants and the Organizer undertake to attempt to reach an amicable solution and to bring a case before the competent courts only in the event that this attempt should fail.

Article 3. Conditions for participation

Participation in this Contest implies the Contestants’ acceptance of all the conditions set out in these Rules.

Both contests are open to any natural person who is an adult at the time of its participation (hereinafter referred to as the “Contestant”).

The following persons are not eligible to enter the Contest: the Organizer, the managers and members of staff of the Organizer, any persons having contributed directly or indirectly to the organization of the Contest, as well as members of their families: spouses or partners, descendants and relatives in the ascending line who live under the same roof and use the same address.

Article 4. Participation process- Stages in the Contest

This Contest includes two successive stages: a scratch ticket and a draw.

Scratch tickets: Contestants must go to one of the Total service stations participating to the Contest between January 6, 2017 and February 6, 2017

Contestants will be given a scratch ticket at the checkout, which could enable them to win one of the prizes.

The winning tickets will give right to the immediate release of the prize at the checkout in the Total service station where the ticket will have been bought.

Each scratch ticket (winning or losing) will contain a number which gives access to the « Draw » under the conditions set out below.

It is stated that the prizes cannot be exchanged in any case against their cash equivalent, or against any other prize of whatever nature, even in case of equal value.

However, in case of force majeure or events out of the Organizer’s control and if the circumstances require it, the Organizer will have the right to grant winners a prize of close characteristics and equal value.

This first stage will be carried out from January 6, 2017 to February 6, 2017 at 7 pm.

A draw (« the Draw »):

To participate in the “Draw”, Contestants must log onto the website: www.http://football-together.total.com/tombola , between January 6, 2017 and February 6, 2017 at 12 pm Paris time (France), to register for the Draw with the activation number of the scratch ticket and complete the relevant application form by indicating:

-           their country

-           their title and name

-           their current e-mail address (optional)

-           their phone number

-           the activation code grant on the scratch ticket

-           their acceptance of the present Rules

 

Participation in the “Draw” cannot take place through any other means than the one described above. Any participation by other means shall be disqualified.

If the entrant is not the owner of the computer and the Internet connection used to participate in the Contest, it shall be assumed that he/she has obtained the owner’s permission to use them.

The Organizer reserves the right to carry out all verifications necessary in terms of Contestants’ identity, age and e-mail address. Any inaccurate, incomplete or fraudulent account created shall be disregarded and disqualified from the Contest.

A draw will take place among the Contestants who will have registered on the website on (indication of the date and place: at least the town, and the exact address if the Draw shall be done in public) in the presence of and under the supervision of a bailiff.

It is stated that the Contestants who would not fill properly the boxes on the form relating to their name, surname, and phone number, at the second stage of the Contest, will not be able to participate to the Draw, since the said Draw would be taking place from these individual-related data.

The Draw’s results will be announced on January 23, 2017. The full name of the winner will be indicated upon the results’ announcement, except his/her email address.

The winner will be granted two (2) places for the final match of the Africa Cup of Nations which will be held on February 5, 2017 in Gabon.

In this case, Organizer shall arrange the transportation and accommodation of the winner.

The winner shall have the responsibility of doing the appropriate formalities in order to be able to go to Gabon (passport and visa). The winner will be solely responsible for the good performance of these formalities.

The Draw’s winner shall be informed by SMS and contacted by the Organizer through the phone number indicated on the application form, in order to agree on the modalities of the prize’s delivery. Rules of “Total Man of the Match”

 

ARTICLE 1 – PRESENTATION OF THE ORGANIZING COMPANY

TOTAL SA, a French corporation with registered capital of 6,321,148,030 euros, registered in the trade and companies register of Nanterre under the number 542 051 180, and having its head office at 2 Place Jean Millier 92400 COURBEVOIE (hereinafter the "Organizing Company"), is organizing, from 12 January 2017 to 5 February 2017, a free game with no purchase obligation entitled "Total Man of the Match" (hereinafter the "Game"), accessible exclusively online on the website football-together.total.com (hereinafter "the Site").

 

ARTICLE 2 – CONDITIONS OF PARTICIPATION

The Game is open to any natural person of legal age having access to the Internet and a valid email address. The Game is governed by French legislation applicable to games and competitions.

The Organizing Company reserves the right to make any necessary checks on the identity, age and email address of Participants.

Any registration based on erroneous, inaccurate, incomplete or fraudulent information shall not be processed and shall render the Participant's entry void.

By playing the Game, Participants are regarded as having accepted unreservedly these rules.

ARTICLE 3 – PROCEDURES FOR PLAYING AND REGISTERING FOR THE GAMES

 

3.1 The Game comprises two sessions:

  • Session 1: Man of the Match: in which the aim for Participants is to predict, for each match at the Total Africa Cup of Nations (Total AFCON) 2017, the soccer player who, out of the two teams contesting each match, will be named Man of the Match by the Confederation of African Football (CAF).
    Each Participant shall be able to name the "Man of the Match" for one or more Matches at Total AFCON 2017 from the time when the Organizing Company publishes online the selection for each team contesting the match in question until kickoff.

Participants shall be able to change their choice as many times as they want per Match until the time the match kicks off.

Three (3) winners shall be drawn at random per match from the correct answers and shall be awarded prizes in accordance with the conditions described in Article 4 below.

 

  • Session 2: Man of the Competition: in which the aim for Participants is to predict the soccer player who will be named Man of the Competition by the CAF after the final of Total AFCON 2017.

Each Participant shall be able to name the "Man of the Competition" throughout the duration of the Game, ie from 12 January to 5 February 2017.

Participants shall be able to change their choice as many times as they wish until the kickoff of the final of Total AFCON 2017.

This session does not in itself entitle Participants to win prizes, but rather to boost their points score in the event that they give a correct answer, in order to improve their ranking in the classification drawn up by the Organizing Company, in accordance with the conditions described below.

 

Each session is separate. Participants may participate in either the "Man of the Match" session, or the "Man of the Competition" session, or both. They may also participate in naming the Man of the Match (session 1) as many times as there are matches during Total AFCON 2017.

3.2 To play, each Participant shall:

  1. Click on the section "TOTAL MAN OF THE MATCH" to access the Game;

 

  1. Click the "Play" button to access the page where they can play the desired Game.

Fill out, in the Game registration form, the following mandatory fields:

  • surname; and
  • first name; and
  • date of birth; and
  • country of residence; and
  • email; and
  • telephone;
  • Password; and

 

If Participants did not fill out the registration form or the login page correctly, they will be informed of this by one or other of the following pop-up messages: "The field XXXX is mandatory" or "The field XXXX is not valid".

Predict the soccer player who will be named "MAN OF THE MATCH" by the Confederation of African Football for the match in question in the Total Africa Cup of Nations 2017, and/or the player who will be named "MAN OF THE COMPETITION" by the Confederation of African Football for the entirety of the Total Africa Cup of Nations 2017, after the final.

ARTICLE 4 – SELECTION OF WINNERS

 

The Game will have 2 categories of winners.

4.1 Winners of Session 1

Fifteen (15) days after the date of the final of AFCON 2017, three (3) participants per match will be drawn at random from the correct answers by the Organizing Company.

They will be awarded the prizes described in Article 5 below.

 

4.2 Overall Winners of the Game

The Game uses the following points system: When each Man of the Match and/or Man of the Competition is named during the 1st and/or 2nd session of the Game, Participants accumulate a certain number of points, enabling the Organizing Company to establish a ranking.

Points are calculated as follows:

  • Registration on the Games website = 30 points
  • Referral of a friend to play the Games = 20 points
  • Sharing of their Games-related predictions on social media (Facebook/Twitter) = 10 points
  • Prediction of the Man of the Match = 100 points

 

Various additional points can be awarded according to the following criteria:

Points can be deducted if the chosen player is cautioned:

  • 1 point deducted for a yellow card
  • 3 points deducted for a red card
  • If the team of the "Man of the Match" concedes a goal/goals: 2 points deducted per goal conceded

 

  • At the end of the competition:

Participants who selected the soccer player named Man of the Competition are eligible for bonus ranking points, added to their points total at the end of the competition:

-100 bonus points are awarded if the final choice was confirmed before the start of the competition and the chosen player is named Man of the Competition.
-50 bonus points are awarded if the final choice was confirmed after the pool phases and the chosen player is named Man of the Competition.
-10 bonus points are awarded if the final choice was confirmed after the semi-finals and the chosen player is named Man of the Competition.

 

ARTICLE 5 – PRIZES

 

5.1 Description of Prizes

  1. Winners of Session 1 "Total Man of the Match"

For each match in AFCON 2017, the winners drawn at random according to the conditions described in Article 4 above will each be awarded the following prize:

- one (1) official Total Africa Cup of Nations, GABON 2017 ball (FIFA-certified), worth €90.

 

  1. Overall Winners of the Game

Throughout Total AFCON, the Organizing Company will draw up a ranking based on the points accumulated by participants in Session 1 and/or Session 2 according to the conditions described in articles 3 and 4 above

 

Fifteen (15) days after the date of the final of Total AFCON 2017, the ten (10) participants at the top of the ranking drawn up by the Organizing Company will be named Overall Winners of the Game (hereinafter "the Overall Winners").

 

The Overall Winners will be awarded the following prizes:

  • Prize 1: prize awarded to the Overall Winner who finishes top of the Ranking: tickets for 2 people to attend the Total CAF Super Cup Match, currently scheduled to be held in Pretoria over the weekend of 18 February (date and venue to be confirmed by the CAF).

VIP package worth an estimated €5,000 (five thousand euros) before tax, including:

  • 2 VIP tickets for the Total CAF Super Cup Match, the date of which will be confirmed later,
  • Return travel (in economy class) from the Overall Winner's town or city of residence to the city where the match is played, currently Pretoria, and
  • Accommodation for 2 to 3 nights (maximum depending on the Overall Winner's town or city of residence) to attend the Total CAF Super Cup Match.
  • Prize 2 awarded to the Overall Winner who finishes 2nd in the ranking: 1 (one) iPhone 7 worth approximately €700;
  • Prize 3 awarded to the Overall Winner who finishes 3rd in the ranking: 1 (one) Apple Watch worth approximately €300;
  • Prize 4 awarded to the Overall Winner who finishes 4th in the ranking: fuel vouchers with an overall value of €150;
  • Prize 5 awarded to the Overall Winner who finishes 5th in the ranking: 1 (one) official Total Africa Cup of Nations, GABON 2017 ball (FIFA-certified), worth €90;
  • Lots 6 to 10 awarded to the Overall Winners who finish 6th to 10th in the ranking: 1 (one) Replica ball (International Match Standard) worth €25.

 

The Winners of the Game will receive an e-mail, at the e-mail address provided in their registration form, within 15 days of the end of the Total Africa Cup of Nations 2017, currently scheduled for 5 February 2017. Any winner who does not respond within 7 days of notification of his/her prize being sent shall be regarded as having declined the prize, which will be awarded to a new winner. .

5.2 Conditions of the award

The Organizing Company reserves the right to make checks on the age of any winner before awarding his/her prize. Prizes shall in no circumstances be exchanged for their cash value or for any other prize. Participants are hereby informed that the sale or exchange of prizes are strictly prohibited. The Organizing Company shall not be held liable for the use, non-use or trading of prizes by winners. In the event of force majeure, the Organizing Company reserves the right to replace the prize won with a prize of equivalent type and value.

The Organizing Company shall not be held liable for sending prizes to an inaccurate address because of negligence on the part of the winner. If the prizes cannot be delivered to their recipient for any reason whatsoever outside the Organizing Company's control (eg the winner moves house without updating his/her address, inaccurate or incomplete address, etc.), they shall permanently remain the property of the Organizing Company.

In any event, the Organizing Company shall not be held liable for any incident and/or accident that may occur during the enjoyment of the prize awarded and/or as a result of its improper use by the winner.

In the event that the winner does not want to or cannot, for any reason whatsoever, take possession or benefit from all or part of the prize won in accordance with the conditions described in these rules, he/she shall be regarded as having declined the complete benefit of the said prize and shall not claim any compensation from the Organizing Company in this respect.

For all intents and purposes, it is hereby stated that the Organizing Company shall provide no service or guarantee linked to the use of the prize in question.

 

5.3 Special conditions for the awarding of the Prize to the Overall Winner of Prize 1 of the Game

In order to benefit from Prize 1, the Overall Winner of the Game and his/her guest must:

  • have valid documents issued by the competent governments and authorities allowing them to travel freely to the match venue and stay there.
  • be up to date with their diphtheria, tetanus, polio, yellow fever and hepatitis A vaccinations
  • be fully aware of the means of preventing malaria
  • provide the Organizing Company with a certificate of civil liability insurance covering the Winner and his/her guest

 

The Overall Winner of Prize 1 states that he/she is fully aware of the above, and releases the Organizing Company from any responsibility in this respect.

In the event of non-compliance with the aforementioned conditions, the Organizing Company reserves the right to swap the Overall Winner of Prize 1 with the Overall Winner of Prize 2, if the latter complies with the aforementioned conditions, or with the subsequent Overall Winners.

No compensation of any kind may be claimed from the Organizing Company in this respect.

 

ARTICLE 6 – IDENTIFICATION OF WINNERS AND DISQUALIFICATION

Participants agree to have their identity and any information contained in their entry form checked. Entry forms that are not fully filled out and/or contain incomplete or false contact details shall not be processed and shall result in the participant's disqualification. Similarly, non-compliance with these rules and any other act of fraud or attempt to cheat, by whatever method, shall result in the disqualification of the participant in question.

ARTICLE 7 – MODIFICATION OF THE DATES OF THE GAME AND INCREASE IN THE NUMBER OF PRIZES

The Organizing Company shall not be held liable in the event of force majeure or events outside its control if it is required to cancel these Games.

The Organizing Company also reserves the right, at any time and without giving notice or being obliged to justify its decision, to shorten, extend, postpone or cancel the Game(s) and to modify all or part of the access conditions and/or methods of implementation of the Game, in the event of force majeure or events outside its control. It shall not be held liable and participants shall not be able to claim any compensation from it in this eventuality.

 

ARTICLE 8 – USE OF WINNERS' IDENTITY

If they are declared winners, it is expressly agreed that the Participants in the Games authorize the Organizing Company to use, for promotional purposes, their first and last names, and their country of residence, without restriction or reservation, and without such use entitling them to any remuneration, rights or benefits of any kind other than the awarding of their prize.

ARTICLE 9 – REIMBURSEMENT OF THE COSTS OF ENTRY

 

9.1. Conditions attached to the refund request

Any Participant in the Games who has complied with the conditions of accessing and playing the Games as described in these rules shall be entitled to a refund of the costs of using a (fixed or mobile) Internet access to log into the site football-together.total.com and to play the Games, simply by writing to the Game Address within a period of ten (10) working days from the end date of the Game (as demonstrated by the post mark) or no later than ten (10) calendar days after the date indicated on the bill concerned from the Internet service provider if the Participant received it after the former period elapsed, stating legibly on paper his/her surname, first name, full postal address, and date(s) and times when he/she logged into the site football-together.total.com in order to play the Game, attaching a copy of the itemized bill from the Internet service provider with which the Participant is under contract, and clearly highlighting the date(s) and times of connection.

 

The name of the Participant requesting the refund must be the same as that stated in the Internet service provider's bill.

 

Any incomplete or illegible request, or a request sent to an address other than the Game Address or after the aforementioned period elapsed (as demonstrated by the post mark), shall be regarded as null.

 

One single refund request per person will be accepted.

 

9.2. Procedures of reimbursement of Internet connection costs

 

The connection costs incurred in playing the Games shall be reimbursed to any Participant who requests such a refund in writing in accordance with the procedures described in Article 9.1 above.

 

In this respect, it is agreed that the Organizing Company undertakes to reimburse only those Participants who accessed the site football-together.total.com using a fixed Internet connection and complied with the Games access and participation conditions described in these Rules.

 

If the Participant accesses the Game using a modem and using a telephone line billed pro rata on the basis of the communication time or the call, and only in this case, he/she may obtain a refund of his/her communications in accordance with the conditions described in Article 9.1, namely by writing to the Game Address, and on the basis of documents proving how long he/she was connected to the site in order to access the Game and the price charged by his/her Internet service provider. The costs of photocopying the supporting documents that must be attached to the refund request shall be reimbursed at a rate of ten euro cents (€0.10) per sheet. Participants may also request, in writing, a refund of the costs of posting the refund request; this written request should accompany the connection costs refund request, and will be fulfilled at the current economy postage rate (basis: 20g). The refund will be fulfilled by postage stamps having a value equivalent to or just over the sum to be refunded within an indicative period of ninety (90) calendar days after receipt of the refund request, once it has been shown to be justified. In this regard, the Organizing Company shall not be liable for any refund if the entry for which a refund is requested does not comply with these Rules, or if the refund request was not made in the form and within the periods stipulated in Article 9.1 above.

 

Insofar as, for some Internet packages, some service providers offer Participants a free or flat-rate connection, it is expressly agreed that any access to the site football-together.total.com made on a free or flat-rate basis (including by cable, ADSL or specialist connection) shall not entitle Participants to any refund. In this event, the Participant subscribes to the Internet service provider's services for his/her use of the Internet in general, and he/she does not incur any additional cost in connecting to the site football-together.total.com and playing the Game. Similarly, the computing or electronic equipment used to play the Game shall not be refunded, as Participants acknowledge and state in this respect that the equipment is for their personal use.

 

ARTICLE 10 – RESPONSIBILITY

By playing the Game, participants recognize and accept the characteristics and limitations of the Internet, the lack of protection of some data against possible misuse or hacking, and the risks of contamination by viruses circulating on the network. The Organizing Network accepts no direct or indirect liability in the event of misuse or incidents arising from use of the computer, from access to the Internet, from the maintenance or a malfunction of the Game servers, the telephone line or any other technical connection, or from the sending of forms to an erroneous or incomplete address. It is the responsibility of all participants to take appropriate measures to protect their own data and/or software stored on their computing equipment against attack. All individuals are wholly responsible for their connection to the site and participation in the Game. The Organizing Company shall not be held liable for the fraudulent use of a participant's connection rights or the awarding of his/her prizes, unless gross negligence can be demonstrated on the part of the Organizing Company.

The Organizing Company reserves the right to disqualify any participant who alters the procedure of registering for the Game, and to cancel, shorten, modify, postpone, adjourn or suspend the Game in the event that the Game servers malfunction, notably as a result of bugs, an unauthorized alteration or intervention, fraud, technical anomalies or for any other reason due to the participant's actions which might affect the administration, security, fairness, integrity or smooth operation of the Games.

The Organizing Company shall make its best efforts to provide access to the Game. The Organizing Company may, at any time, notably for technical reasons, including for updates and maintenance, interrupt access to the site and to the Game. The Organizing Company shall not be liable for these interruptions and their consequences. No compensation shall be claimed in this respect.

Participants are hereby informed that when accessing the Game website, a cookie may be stored on their computer's hard drive. A cookie is a small electronic file that records their browsing of the Game website. Cookies are used to identify each participant in order to enable them to access information more quickly, and avoid them having to re-enter it. They will never damage the data stored on participants' computers. Participants may prevent this cookie from being stored or choose to be informed of its storage on their hard drive by changing their browser settings (participants are invited to see the conditions of use of their browser regarding this feature). When these settings are made, participants will still be able to access the Game website and play the Game.

Moreover, the Organizing Company shall not in any circumstances be held liable for problems regarding the delivery or loss of postal or electronic mail (including regarding the delivery of prizes). Any prize sent to a winner by the Organizing Company that is unclaimed or returned for any other reason by the postal services shall be withdrawn from the winner and shall remain the property of the Organizing Company. The Organizing Company shall not be held liable for the malfunctioning of the Internet network, nor for any delays, losses or damage caused by postal or management services.

ARTICLE 11 – INTELLECTUAL, LITERARY AND ARTISTIC PROPERTY RIGHTS

The images used for the Game, the objects depicted, the trademarks and trade names mentioned, and the Game's constituent graphic and electronic elements and databases are the exclusive property of their respective owners and shall not be extracted, reproduced or used without the written permission of the said owners, under penalty of civil and/or criminal proceedings. Any resemblance between characters or elements in the Game and other fictional characters or other existing games is purely coincidental and the Organizing Company or its service providers shall not be held liable in this respect. In general, participants undertake to cover the organizers of the Game for all liability in respect of claims, legal actions or complaints that any third party might bring for any reason in respect of the use of the authorizations granted in these rules, and more generally in respect of all guarantees and commitments made under these rules. Participants agree to release the organizers from any responsibility in the event of complaints made by third parties as a result of infringement of copyright or breach of operating or property rights, of whatever kind.

 

ARTICLE 12 – FRENCH DATA PROTECTION ACT

12.1. The personal data collected in the context of the Games are mandatory. They are intended for the Organizing Company, and for TOTAL MARKETING SERVICES and, as applicable, its subsidiaries. They shall be sent to their partners the Lagardère company, the Havas & Entertainment company and the CAF, and the Malherbe company, solely for the purposes of registering participation in the Game, managing the Winner, awarding prizes, and complying with legal and regulatory obligations.

 

In accordance with the amended act no. 78-17 dated 6 January 1978 relating to computing, electronic files and liberty (the "Loi Informatique et Libertés", the French data protection act), all Participants have the right to access, correct, delete and object to the use of their personal data. Any Participant may exercise this right, either by filling out the contact form, or by writing to the Game Address, indicating their first name, surname and postal address, and attaching a copy of an ID document:

Insofar as the data collected on each Participant during the course of the Games are essential for registering their participation and awarding any prize they may win, should Participants exercise their right of withdrawal before the end of the Games, this will result in the automatic cancellation of their participation in the Game.

 

12.2. Each Participant in the Game acknowledges that they have read the requirements of the Rules in full, and agree to them in full knowledge of the facts. By playing the Game, the Winner authorizes, free of charge, the Organizing Company to use his/her first name(s), surname, and town/city of residence on the Site. In the event that the Winner does not wish the Organizing Company to use this information in this way, he/she should inform the Organizing Company thereof in writing.

 

ARTICLE 13: FILING OF THE RULES 

 

13.1 Filing and consultation

The rules of the Game will be sent, free of charge, to any person who requests them via the contact form on the Site.

The French version of these rules shall take precedence over all others.

Any version other than the French version shall constitute merely a translation for convenience purposes.

 

13.2 Changes to the Rules

The Organizing Company reserves the option to make any changes to the Rules and/or to the Site, at any time, without giving notice or being obliged to explain its decision, and it shall not be held liable in this respect.

 

Any changes to the Rules shall result in a new version being filed with: SCP Alain SARAGOUSSI – Rémi CHAVAUDRET, associate bailiffs, 33 galerie Véro-Dodat 75001 PARIS; the new Rules shall come into force with effect from their publication online. All participants are deemed to have accepted them merely by playing the Game, with effect from the date of entry into force of the change. Any participant who rejects the change(s) made should stop participating in the Games.

 

ARTICLE 13 – JURISDICTION AND INTERPRETATION OF THE RULES

Any dispute regarding the interpretation of the rules shall be settled by the Organizing Company. By playing this Game, participants accept unreservedly (i) these rules and all their stipulations, and (ii) the laws and regulations in force in France, notably the current provisions applicable to games and lotteries. No telephone or written request shall be responded to concerning the interpretation or application of these rules, the mechanisms or requirements of the Games, or the list of winners. Except in the case of manifest errors, it is agreed that the information resulting from the Organizing Company's Game systems shall be conclusive in any dispute regarding connections and the electronic processing of the said Game-related information. Prior to any legal action linked to or in connection with these rules (in particular their application or interpretation), participants agree to work with the Organizing Company in good faith to find an amicable solution. Participants are subject to French legislation applicable to games and competitions. Any dispute which cannot be settled amicably shall be governed by the courts with jurisdiction for the Organizing Company's head office, unless public policy provisions state otherwise.

CONTEST RULES I CAN CELEBRATE

 

2. Contest period

 

The Contest begins on January 17, 2017 starting at 6:00 pm and will end on February 10, 2017 at 12:00 pm (date and time of connection from metropolitan France).

 

3. Contest terms of eligibility

 

3.1 Participation in the Contest is open to any natural person of at least 18 years of age at the time the Contest begins, working for the Organizing Company (Total), who has Internet access (fixed or mobile) at the date the Contest begins as well as an account in his/her name on the Site and a professional email address where, if necessary, he/she can be contacted for reasons pertaining to the management of the Contest (hereinafter the “Participant” or the “Participants”).

 

3.2 Each Participant can participate once (same name, same mailing address, same email address) and only one participation per household (same name, same mailing address, same IP address) is authorized for the duration of the Contest.

If there are attempts to participate multiple times, the entry/entries from the household will be declared invalid.
 

3.4 Those who do not meet the conditions described in these rules will be excluded from participating in the Contest.

 

3.5 Only those whose participation conforms to all of the stipulations in these rules (hereinafter the “Rules”) will be accepted. To this end, the Organizing Company reserves the right to make any checks that it judges useful on the identity, age, contact details, physical aptitude and knowledge of the rules of soccer of each Participant. Any information provided by a Participant in the scope of Contest registration described in article 4 below that is incomplete, erroneous, falsified or does not make it possible to identify or localize this Participant will lead to the cancellation of his/her participation in the Contest.

 

3.6 Participation in the Contest involves unreservedly accepting the Contest's Rules and its guidelines. Any act of fraud, or attempt at fraud, shown by the beginning of its implementation and committed with the aim of wrongfully obtaining a prize, not respecting the Rules or any malicious intent to disrupt the proceedings of the Contest, may lead to the [JE1] removal of the person responsible, the Organizing Society reserving the right to pursue legal action. Similarly, if it happens that the proceedings of the Contest are disrupted by a third party but that a Participant is an accomplice of these doings, his/her participation will be regarded as null and legal proceedings may be taken by the Organizing Company against him/her.

 

4. Contest entry and participation

 

Participation in the Contest is done exclusively by Internet according to the procedures described below. Participation in any other form and by any other means, especially by mail, will not be considered.

 

To play, each Participant must, between January 17, 2017 starting at 6:00 pm and February 10, 2017 at 12:00 pm (date and time of connection from metropolitan France):

 

1. Log into the site football-together.total.com then go to the tab "At the Heart of Total AFCON 2017" to access Total's digital contests published online as part of the Total Africa Cup of Nations – Gabon 2017";

 

2. Click on the “I Can Celebrate” section to access the game;

 

3. Click the "Register" button to access the Contest participation page reserved for Total employees.

> Fill out, in the Contest registration form, the following mandatory fields:
 

  • last name; and
  • first name; and
  • date of birth; and
  • country of residence; and
  • email (work); and
  • telephone;
  • Total loyalty card: yes or no; and
  • If yes, card number; and
  • Password
     

     > Registered users of the site should enter, on the login page, their professional email address and password.

 

Check, at the end of the registration form, the following box: “I accept the rules of the game” and click on “Register”
 

  • If the Participant did not fill out the registration form or the login page correctly, he/she will be informed of this by one or other of the following pop-up messages: "The field XXXX is mandatory" or "The field XXXX is not valid."

 

4. Choose the Total AFCON 2017 team to support, then click on the “OK” button to validate his/her choice; 

 

5. Download his/her video in GIF format, over which he/she is in possession of all rights, then click the "OK" button to complete his/her entry. The gif is found on the gallery page corresponding to the country chosen.

 

6. The participant can then download his/her gif, send one or several emails to his/her colleagues to receive more votes or go to the gallery to vote for different entries.

 

The 11 participants receiving the most votes will be elected winners of the game.

If several participants receive the same number of votes, a draw will be held to decide between them and elect the 11 game winners.

 

5. Selection of Winners and information on Winners

 

Participation in the Contest is done exclusively by Internet according to the procedures described below. Participation in any other form and by any other means, especially by mail, will not be considered.

 

Only those entries validated before the end of participation will be taken into account.

 

The eleven (11) participants receiving the most votes will be elected winners of the game. As a result, if there is a tie between participants, the Organizing Company will hold a draw to decide between them. This will take place within three (3) days following the end of the Contest.

 

The Organizing Company will inform the Winners of their prize within a maximum of three (3) working days following the day the Winners are selected. The Winners will be informed by the Organizing Company by email, at the email address given when registering for the Contest. At this moment, the Winners will confirm whether they will accept the prize.

 

For the sake of clarification, it is noted that Participants who are not winners will not be notified.

 

If the Organizing Company does not receive a response from the Winner that conforms to the aforementioned conditions and time limit, or if the Winner expressly renounces his/her prize within forty-eight (48) hours after having been contacted by the Organizing Company, the prize will be considered as lost for this Winner and will be awarded to another Participant.

The values indicated for the prizes listed above correspond to the standard or estimated retail price including taxes at the time these Rules were written. They are provided for information purposes only and are subject to change.

 

The prizes at stake include only that which is listed above, and exclude all other things, such as telephone communication, fax or Internet, upgrades, purchases and other personal expenses, which are entirely and exclusively the responsibility of the winners.

No prize awarded shall be the subject of a dispute of any kind on the part of any of the Winners. Each prize awarded is strictly personal, such that it cannot be given or sold to any third party whatsoever; the Organizing Company shall not provide a monetary reimbursement or an exchange of any kind, in whole or in part, whether in cash or in kind. Nevertheless, in the event of force majeure such as defined by the law and legal precedent, the Organizing Company reserves the right to replace one of the announced prizes with a prize of equivalent value and/or characteristics.

 

One and only one prize will be awarded per person throughout the duration of the Contest and no remuneration may be requested.

 

6.2 Essential and determining conditions for the receipt of prizes

 

In order to benefit from his/her prize, each Winner and his/her guest must:

 

-have valid documents issued by the competent governments and authorities allowing them to travel freely to the match venue and stay there;

-be up to date with their diphtheria, tetanus, polio, yellow fever and hepatitis A vaccinations;

-be fully aware of the means of preventing malaria;

provide the Organizing Company with a certificate of civil liability insurance covering the Winner and his/her guest

 

Each Winner states that he/she is fully aware of the above, and releases the Organizing Company from any responsibility in this respect.

 3. In the event that the Winner and/or his/her traveling companion do not meet the conditions described above, the prize will be considered as lost and the Organizing Company will be free to choose another Winner.

 

6.3. Awarding the prize

 

The details of the trip will be sent by email to the Winners at the address given to the Organizing Company at the time of their registration within three (3) calendar days starting from reception of all of the documents described in section 6.2 above.

Any prize not delivered and returned to the Organizing Company in the event of an incomplete or incorrect email address given by a winner will by lost for the latter and will remain with the Organizing Company, which shall not be held responsible in this eventuality. Moreover, the Organizing Company accepts no responsibility in the event of an incident or accident that could occur in connection with the enjoyment of this prize.

 

Given that match tickets are the prize, the Winner promises to respect, on the one hand, the general sales conditions made publicly accessible by the match organizer and applicable to the seats won and, on the other hand, the internal rules of the stadium, the procedures for entering the stadium, the stands and the field, as well as the legal and regulatory measures applicable in the stadium during matches played there, notably concerning security, which are made publicly accessible by the organization in charge of stadium security.

 

To this end, the Winner is informed that he/she will be held directly and personally responsible for not respecting the aforementioned rules and that the Organizing Company shall in no way be held liable in this eventuality. In particular, the Winner is informed that any match ticket placed on the secondary market or put up for resale on an Internet site of any kind is subject to be immediately declared void by the match organizer, and the winner shall not obtain from the Organizing Company any reimbursement whatsoever, nor is the possibility excluded of legal action being taken by the match organizer against the reseller.

 

In any event, the Organizing Company shall not be held liable for any incident and/or accident that may occur during the enjoyment of the prize awarded and/or as a result of its improper use by the Winner and/or the person accompanying him/her.

 

In the event that the Winner does not want to or cannot, for any reason whatsoever, take possession or benefit from all or part of the prize won in accordance with the conditions described in these rules, he/she shall be regarded as having declined the complete benefit of the said prize and shall not claim any compensation from the Organizing Company in this respect.

 

For all intents and purposes, it is hereby stated that the Organizing Company shall provide no service or guarantee linked to the use of the prize in question.

 

7. Legal filing and consultation of the Rules

The rules of the Competition will be sent, free of charge, to any person who requests them via the contact form on the Site.

The rules may also be read in their entirety on the website football-together.total.com.

 

The French version of these rules shall take precedence over all others.

Any version other than the French version shall constitute merely a translation for convenience purposes.

 

8. Changes to the Rules

 

The Organizing Company reserves the option to make any changes to the Rules and/or to the Site, at any time, without giving notice or being obliged to explain its decision, and it shall not be held liable in this respect.

Any changes to the Rules shall result in a new version being filed with: SCP Alain Saragoussi – Rémi Chavaudret, associate bailiffs, 33 galerie Véro-Dodat 75001 Paris, France; the new Rules shall come into force with effect from their publication online. All participants are deemed to have accepted them merely by participating in the Contest, with effect from the date of entry into force of the change. Any participant who rejects the change(s) made should stop participating in the Contest.

 

The Organizing Company reserves the right, at any time and without giving notice or being obliged to justify its decision, to shorten, extend, postpone or cancel the Contest and to modify all or part of the access conditions and/or methods of implementation of the Contest, in the event of force majeure or events outside its control. It shall not be held liable and participants shall not be able to claim any compensation from it in this eventuality.

 

9. Reimbursement of the costs of entry (Internet connection costs)

 

9.1. Conditions attached to the refund request

 

Any Participant in the Contest who has complied with the conditions of accessing and participating in the Contest as described in these rules shall be entitled to a refund of the costs of using a (fixed or mobile) Internet access to log into the site football-together.total.com and to participate in the Contest, simply by writing to the Contest Address within a period of ten (10) working days from the end date of the Contest (as demonstrated by the post mark) or no later than ten (10) calendar days after the date indicated on the bill concerned from the Internet service provider if the Participant received it after the former period elapsed, stating legibly on paper his/her last name, first name, full postal address, and date(s) and times when he/she logged into the site football-together.total.com in order to participate in the Contest, attaching a copy of the itemized bill from the Internet service provider with which the Participant is under contract, and clearly highlighting the date(s) and times of connection.

 

The name of the Participant requesting the refund must be the same as that stated on the Internet service provider's bill.

 

Any incomplete or illegible request, or a request sent to an address other than the Contest Address or after the aforementioned period elapsed (as demonstrated by the post mark), shall be regarded as null.

 

One single refund request per person will be accepted.

 

9.2. Procedures of reimbursement of Internet connection costs

 

The connection costs incurred in participating in the Contest shall be reimbursed to any Participant who requests such a refund in writing in accordance with the procedures described in Article 9.1 above.

 

In this respect, it is agreed that the Organizing Company undertakes to reimburse only those Participants who accessed the site football-together.total.com using a fixed Internet connection and complied with the Contests access and participation conditions described in these Rules.

 

If the Participant accesses the Contest using a modem and using a telephone line billed pro rata on the basis of the communication time or the call, and only in this case, he/she may obtain a refund of his/her communications in accordance with the conditions described in Article 9.1, namely by writing to the Contest Address, and on the basis of documents proving how long he/she was connected to the site in order to access the Contest and the price charged by his/her Internet service provider. The costs of photocopying the supporting documents that must be attached to the refund request shall be reimbursed at a rate of ten euro cents (€0.10) per sheet. Participants may also request, in writing, a refund of the costs of posting the refund request; this written request should accompany the connection costs refund request, and will be fulfilled at the current economy postage rate (basis: 20 g). The refund will be fulfilled by postage stamps having a value equivalent to or just over the sum to be refunded within an indicative period of ninety (90) calendar days after receipt of the refund request, once it has been shown to be justified. In this regard, the Organizing Company shall not be liable for any refund if the entry for which a refund is requested does not comply with these Rules, or if the refund request was not made in the form and within the periods stipulated in Article 9.1 above.

 

Insofar as, for some Internet packages, some service providers offer Participants a free or flat-rate connection, it is expressly agreed that any access to the site football-together.total.com made on a free or flat-rate basis (including by cable, ADSL or specialist connection) shall not entitle Participants to any refund. In this event, the Participant subscribes to the Internet service provider's services for his/her use of the Internet in general, and he/she does not incur any additional cost in connecting to the site football-together.total.com and participating in the Contest. Similarly, the computing or electronic equipment used to participate in the Contest shall not be refunded, as Participants acknowledge and state in this respect that the equipment is for their personal use.

 

10. Responsibilities

 

10.1. The responsibility of the Organizing Company is strictly limited to the delivery of prizes actually and validly won.

 

10.2. It is expressly reminded that the Internet is not a secure network. In this regard, participation in the Contest implies the knowledge and acceptance, by all Participants, of the characteristics and limitations of the Internet, in particular with regard to technical performance, response time for accessing, searching or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission over the Internet in general, the absence of protection of certain data against possible leaks and the risks of contamination by possible viruses on the Internet.

 

Consequently, the Organizing Company cannot be held responsible, in particular for possible contamination by a virus or intrusion by a third party into the Contest Participant’s terminal system, and the Organizing Company declines all responsibility for the consequences of the Participants’ connection to the network.

 

In particular, the Organizing Company cannot be held responsible for any damages caused for the Participants, their computer equipment and the data stored therein, or for any consequences that could result with regard to their personal or professional activity. It is the responsibility of all Participants to take appropriate measures to protect their own data and/or software stored on their computing equipment against attack. All individuals are wholly responsible for their connection to the site football-together.total.com and their participation in the Contest is entirely their responsibility.

 

10.3. The Organizing Company also does not accept any responsibility in the event of Internet problems, problems with the site football-together.total.com, problems with telephone lines, or problems with reception equipment that prevent the Contest from working properly.

 

The Organizing Company shall not be held responsible in the event that one or several Participants are not able to connect to the site football-together.total.com or to play as the result of any problem or technical issue linked notably to network overload.

 

The Organizing Company may cancel all or part of the Contest if it appears that there has been fraud of any kind, particularly IT fraud in the scope of Contest participation or the determining of Winners. If such an event occurs, the Organizing Company reserves the right to not award prizes to those who engaged in fraud and/or to take legal action with the relevant authorities against those who committed these fraudulent acts. The Organizing Company shall not accept any responsibility with respect to the Participants in the event that any acts of fraud are committed.

 

10.4. The Organizing Company will do its best to always make access to the Contest on the site football-together.total.com possible, without being obliged to succeed in this attempt. The Organizing Company may, at any time, notably for technical reasons, or for updates or maintenance, interrupt access to the site and/or to the Contest on the site. The Organizing Company shall not be liable for these interruptions and their consequences.

 

10.5. Moreover, the Organizing Company shall not under any circumstances be held liable for problems regarding the malfunction of the Internet, problems with the delivery or loss of postal or electronic mail, or any damages caused by the postal services.

 

11. Agreement of proof

 

The Organizing Company has implemented the necessary technical means to demonstrate the participation or non‐participation in the Contest by an Internet user. Therefore it is agreed that, unless there is evident error, the data contained in the Organizing Company’s information systems have probative force with regard to connection information and other information resulting from IT processing related to the Contest.

 

It is agreed that, except in the case of evident error, the Organizing Company could, in particular for the purpose of proving any action, fact or omission, invoke as proof the programs, data, files, recordings, operations or other elements (such as tracking reports or other statements) of a computerized or electronic nature or format or support, that have been produced, received or conserved directly or indirectly by the Organizing Company, in particular in its information systems.

 

The Participants agree that they will not contest the admissibility, validity or probative force of the aforementioned elements of a computerized or electronic nature or format or support, on the basis of any legal provision whatsoever that would specify that certain documents must be written or signed by the parties to constitute a proof. Thus, the elements under consideration constitute proofs and, if they are produced as means of evidence by the Organizing Company in any contentious procedure or other procedure, they shall be admissible, valid and opposable between the parties in the same manner, under the same conditions and with the same probative force as any document that is produced, received or conserved in writing.

 

12. Intellectual property

 

All the creations, names or brands cited in the Rules, as well as any communication support relating to the Contest, shall remain the exclusive property of the Organizing Company.

 

The reproduction, representation or exploitation without prior written authorization from the Organizing Company of all or part of the elements that make up the Contest (photos, videos, names, logos, brands, etc.) is strictly forbidden.
 

Participation in the Contest involves transferring copyright the Participant has on the original works he/she has conceived. This transfer of rights will be confirmed in the following terms:
 

  • The Participant cedes to the Organizing Company, or any company that may be substituted for it, the right to reproduce, have reproduced, represent, have represented and adapt the creations addressed to the Organizing Company within the scope of the Contest, on the media mentioned below.

 

  • The Participant expressly accepts that his/her creations be reproduced/represented on the following media:

  • The Organizing Company’s Twitter account  
  • The football-together.total.com site.

 

  • This authorization is given free of charge, for the entire world, for a length of three (3) years starting from the date at which he/she is designated a winner by the Organizing Company.

 

  • The Participant certifies that he/she has the ability to consent to the present transfer and he/she guarantees the Organizing Company unobstructed use of his/her creations, notably against any removal by a third party, in any way whatsoever, for the use of his/her creations and of those persons and goods therein.

13. Personal data protection

 

13.1. The personal data collected in the context of the Contest are mandatory. They are intended for the Organizing Company, and for TOTAL MARKETING SERVICES and, as applicable, its subsidiaries. They shall be sent to its partner, HAVAS SPORTS solely for the purposes of registering participation in the Contest, managing the Winner, awarding prizes, and complying with legal and regulatory obligations.

 

In accordance with the amended act no. 78-17 dated January 6, 1978 relating to computing, electronic files and liberty (the "Loi Informatique et Libertés," the French data protection act), all Participants have the right to access, correct, delete and object to the use of their personal data. Any Participant may exercise this right, either by filling out the contact form or by writing to the Contest Address, indicating their first name, last name and postal address, and attaching a copy of an ID document:

Insofar as the data collected on each Participant during the course of the Contest are essential for registering their participation and awarding any prize they may win, should Participants exercise their right of withdrawal before the end of the Contest, this will result in the automatic cancellation of their participation in the Contest.

 

13.2. Each Participant in the Contest acknowledges that they have read the requirements of the Rules in full, and agree to them in full knowledge of the facts. By participating in the Contest, the Winner authorizes, free of charge, the Organizing Company to use his/her first name(s), last name, town/city of residence and his/her drawing on the Site. In the event that the Winner does not wish the Organizing Company to use this information in this way, he/she should inform the Organizing Company thereof in writing.

 

14. Applicable law and relevant jurisdiction

 

Should one or several stipulations of the present rules be declared null and/or non-applicable, the other clauses shall remain in force.

 

The Participants unreservedly accept that the simple fact of participating in the Contest makes them subject to French laws, particularly for any lawsuit that may arise from the fact of this Contest or which may be linked to it directly or indirectly, without prejudice to any conflict-of-law rules that may exist. Any disagreement arising from the Contest will be attempted to be settled amicably between the Organizing Company and the Participant. If no agreement is reached, the lawsuit shall be subject to French jurisdiction in accordance with the measures of the Code de Procédure Civile (the Civil Procedure Code).

 

No telephone or written request shall be responded to concerning the interpretation or application of these Rules, the mechanisms or requirements of the Contest, or the naming of Winners.
